Accurate measurement of livestock weight is a primary indicator in the meat industry to increase the economic gain. In lambs, the weight of a live animal is still usually estimated manually using traditional scales, resulting in a tedious process for the experienced assessor and stressful for the animal. In this paper, we propose a solution to this problem using computer vision techniques; thus, the proposed procedure estimates the weight of a lamb by analysing its zenithal image without interacting with the (...) animal, which speeds up the process and reduces weighing costs. It is based on a data-driven decision support system that uses RGB-D machine vision techniques and regression models. Unlike existing methods, it does not require walk-over-weighing platforms or special and expensive infrastructures. The proposed method includes a decision support system that automatically rejects those images that are not appropriate to estimate the lamb weight. After determining the body contour of the lamb, we compute several features that feed different regression models. Best results were achieved with Extra Tree Regression ($R^{2}$=91.94%), outperforming the existing techniques. Using only an image, the proposed approach can identify with a minimum error the optimal weight of a lamb to be slaughtered, so as to maximise the economic profit. (shrink)

El manejo y alivio del dolor es un derecho humano universalmente reconocido como tal, susceptible del escrutinio ético y bioético, toda vez que implica la toma de decisiones que comprometen la calidad de vida de las personas. El dilema ético sobre el manejo del dolor suele entrañar conflictos de valores en las decisiones cruciales, sobre todo cuando no hay una única (...) alternativa, tratamiento y estrategias de intervención lo suficientemente compartidas y aceptadas. El problema ético y bioético en el manejo del dolor, sobre todo en pacientes con padecimientos crónicos y/o estado de estrés, al final de la vida sigue representando un desafío para la práctica clínica, con consecuencias diversas en los pacientes adultos y repercusiones en los sistemas de salud y el entorno familiar y social de dichos pacientes. This article addresses the work of the German artist Hannah Höch in the light of the struggle for abortion rights in the Weimar Republic. I attempt to show how Höch’s uses of the technique of photomontage can be read as a way of introducing a distance between the work and the viewer that allows us to question the beliefs we use to make sense of the world. Specifically, I discuss her photomontage Mutter, a version of a photograph taken by John (...) Heartfield, and some of her writings and interviews. I also examine closely the material conditions and political debates in which Höch’s work – as a social practice – developed. After a brief introduction and a methodological outline, I present Höch in the context of Berlin Dada and summarise the main underlying arguments of my hypothesis. Namely, that the major interest of Höch’s photomontages lies in the complex articulation of activism and philosophy, and in the way in which they put mainstream categories into question by ‘distancing’ fragments of reality. La tecnificación y las grandes catástrofes militares y sociales del siglo XX condujeron a un autor como Husserl a reivindicar un concepto como el de Lebenswelt. Tras este acercamiento hay una reflexión sobre el yo y el otro que se ha querido poner de manifiesto en este artículo a fin de destacar dos conceptos como el de posibilidad y facticidad. Las variaciones imaginarias husserlianas y los testimonios de los supervivientes de los campos de exterminio han servido para destacar y definir (...) tales conceptos, así como un acercamiento a la memoria como concepto que podría marcar un punto de contacto entre ambos.The technification and the great military and social disasters of the twentieth century led an author like Husserl to claim a concept like Lebenswelt. Behind this approach there is a reflection on the self and the other that one has wanted to highlight in this article, two concepts such as possibility and factuality. The Husserlian imaginary variations and the testimonies of the survivors of the extermination camps have served to highlight and define such concepts, as well as an approach to memory as a concept that could mark a point of contact between both. La presente comunicación pretende desbrozar el proceso de deshumanizaciónal que fue sometido el ser humano en los campos de exterminio. Todo ello, y en la medida de lo posible, atendiendo de manera fundamental a los testimonios de los sobrevivientes, como Primo Levi, Jean Amery, Víktor Frakl, etc. spa, la pérdida del lenguaje y la imposibilidad de ponerse en el lugar del otro, además de la anulación de la comunicación. Para finalizar con la reivindicación de la memoria y el testimonio como (...) estructura de recuperación de una humanidad perdida. Además de destacar la figura del testigo como la posible transformación de una subjetividad que se ve sometida a un sufrimiento transformador de la relación del hombre con el mundo.The present paper aims to clear a path through the process of dehumanizationto which the human being was subjected in the extermination camps, considering principally, and as far as possible, the testimony of the survivors, such as Primo Levi, Jean Améry and Viktor Frakl. In this process the emphasis has been placed on the reduction to bare flesh, language loss, and the impossibility of putting oneself in the place of another, as well as the annihilation of communication. The paper closes with the claim of memory and testimony as a structure for recovering a lost humanity, and also highlights the figure of the witness as a possible transformation of a subjectivity which undergoes a suffering transforming the relationship between man and world. Diseases of complex origin have a component of quantitative genetics that contributes to their susceptibility and phenotypic variability. However, after several studies, a major part of the genetic component of complex phenotypes has still not been found, a situation known as “missing heritability.” Although there have been many hypotheses put forward to explain the reasons for the missing heritability, its definitive causes remain unknown. Complex diseases are caused by multiple intermediate phenotypes involved in their pathogenesis and, very often, each one (...) of these intermediate phenotypes also has a component of quantitative inheritance. Here we propose that at least part of the missing heritability can be explained by the genetic component of intermediate phenotypes that is not detectable at the level of the main complex trait. At the same time, the identification of the genetic component of intermediate phenotypes provides an opportunity to identify part of the missing heritability of complex diseases. (shrink)

Fundamentación: el desarrollo de la cultura profesional docente colaborativo se sustenta en los postulados vigotskianos, donde se concibe al profesor como un sujeto comprometido con las demandas y exigencias de la sociedad. Objetivo: socializar las categorías de análisis que se deben tener en cuenta en un colectivo docente para el desarrollo de una cultura profesional colaborativa en el proceso de formación del profesional de la educación superior. Método: se realizó un estudio etnográfico en la Universidad José Martí Pérez, de Sancti (...) Spíritus, apoyada en la metodología cualitativa y un grupo de técnicas posibilitó la recogida de la información. Resultados: se obtuvieron las categorías de análisis que están estrechamente asociadas al deber ser de un docente universitario, portador de esta cultura. Conclusiones: a partir de la coincidencia de criterios sobre los aspectos teóricos y la reflexión colectiva emergieron elementos indispensables en un colectivo para lograr la cultura profesional docente colaborativa a la cual se aspira, elaborados al tener en cuenta su estructura de contenido y forma. Background: the development of collaborative professional teaching culture is based on Vigotskian statements, where the teacher is seen as an individual compromised with the demanding and needs of the society. Objective: Socialize the analytical categories that should be taken into consideration in a teaching staff for the development of collaborative professional teaching culture in the process formation of the professional of higher education. Method: an ethnographic study was carried out in the University José Marti Pérez, from Sancti Spiritus, based on a qualitative methodology and a group of techniques that make data collection possible. Results: The analytical categories obtained were closely linked to the requirements of a university teacher that has this culture. Conclusions: starting from common criteria about theoretical aspects and group reflection, vital elements emerged in the teaching staff to get the collaborative professional teaching culture that is needed, elaborated taking into account its structure of content and form. Es necesario enfocar escépticamente las pocas referencias a Pitágoras y los pitagóricos contenidas en los diálogos de Platón, pues resulta difícil tomar la medida efectiva de una influencia pitagórica sobre el ateniense. De hecho, las únicas referencias explícitas a Pitágoras (Rep. X 600a-b) y a los pitagóricos (Rep. VII 530c-531a) no nos dicen mucho y, respecto a los personajes tradicionalmente considerados pitagóricos, nuestra información es poco fiable, incierta y a veces contradictoria. Tal prudencia es particularmente útil en el caso de (...) Timeo y del personaje homónimo de este diálogo, cuyo pitagorismo, aunque ampliamente aceptado por los comentaristas, parece muy discutible. Así sólo la aplicación de un método histórico prudente y lúcido puede evitar esta deriva que identifica como pitagórico toda referencia a la transmigración del alma y las matemáticas en sentido amplio. El presente trabajo es un estudio descriptivo y con un enfoque sincrónico que da muestra de las deficiencias de los profesores universitarios al redactar textos científicos. Este estudio tiene como objetivo proponer varias acciones de superación para perfeccionar el manejo del lenguaje y el arte de redactar de los docentes de la Universidad de Ciencias Médicas "Dr. Faustino Pérez Hernández" de la provincia Sancti Spíritus que cursan la octava edición de la Maestría en Ciencias de la Educación de la Universidad (...) de Sancti Spíritus "José Martí Pérez". Para darle cumplimiento a este propósito, se aplicaron varios métodos y técnicas de recolección de datos a una muestra seleccionada al azar de informantes y de sus publicaciones, lo que permitió fundamentar la existencia de varias problemáticas en la redacción científica de dichos profesores y la necesidad de implementar formas organizativas básicas del proceso de educación de posgrado para su inmediata y eficaz aplicación. The present work is a descriptive study grounded in a synchronic approach that identifies the deficiencies of university professors when writing scientific texts. This study aims to propose several measures to improve the use of language and the art of writing of teachers of the " Dr. Faustino Pérez Hernández" University of Medical Sciences in Sancti Spíritus, Cuba who are participating in the eighth edition of the Master's Degree in Educational Sciences program at the "José Martí Pérez" University, also located in Sancti Spiritus. Several methods and techniques of data collection were applied to a random sample of informants and their scientific articles. This allowed for the detection of several problems in scientific writing and the need to implement basic organizational forms of postgraduate education for immediate and effective application. Se presenta una revisión bibliográfica en la que se valora la implementación de las estrategias curriculares en la Licenciatura en Enfermería, a partir de las asignaturas impartidas en el segundo año de la carrera. Se destaca la importancia de estos recursos pedagógicos en la formación de los estudiantes, su desarrollo y contribución a la solución de situaciones relacionadas con el cuidado, la calidad de la atención de salud, la disminución de eventos adversos y la seguridad del paciente. Las estrategias curriculares (...) vinculadas a la carrera de Enfermería constituyen una forma particular de desarrollar el proceso docente, caracterizadas por una direccionalidad coordinada que responde al perfil de salida del egresado, en la que se imbrican los contenidos y métodos teóricos y prácticos de las unidades curriculares correspondientes al plan de estudio, a partir de una estructura metodológica que garantiza su funcionamiento. Ello contribuye a la formación integral de un profesional competente. A bibliographic revision is presented in order to assess the implementation of curricular strategies in Nursing 2nd year subjects. The importance of teaching aids in students' training, their development and contribution to solve issues related to care and quality of the health system, the lowering of adverse events and the patient´s safety are pointed out. Curricular strategies related to Nursing represent a particular way to develop the teaching process, characterized by a coordinated direction which responds to the graduate's experience, in which theoretical and practical methods and contents of the curricular units that belong to the syllabus are interwoven, starting from a methodological structure that ensures these strategy functions. Using the lens of conceptual history, we analyze the evolution of the term digital commons since it first came to be publicly used. In particular, we track down how the meaning of the term digital commons was influenced after its emergence by a new modulation of the term commons developed from neo-Marxist coordinates. Exploring the way in which this neo-Marxist way of thinking the commons emerged after the economic crisis of 2008 thanks to the discursive interventions of a couple of (...) authors more or less linked to the Midnight Notes Collective, we subsequently analyze the degree of penetration of this new conception of the commons in the realm of the digital commons. As we conclude, the disparate reception of this conception on the way different authors think and theorize the digital commons confirms the essentially contested nature of this particular concept. El propósito de esta investigación es caracterizar la inversión española en Ecuador, y analizar las percepciones sobre ésta de las empresas ibéricas que desarrollan su actividad en esta república Latinoamericana. Esta información es de especial relevancia para las instituciones gubernamentales, y para los potenciales inversores. Para realizar el trabajo se utilizó una metodología cualitativa con una perspectiva socioeconómica de tipo exploratoria de bola de nieve. Los resultados muestran como principal conclusión que los diez años del gobierno del presidente Rafael Correa (...) han sido positivos para la inversión en términos generales debido a la continuidad del gobierno que influyó en una mayor estabilidad política y social, que dio lugar a un periodo de crecimiento económico por encima de muchos países desarrollados. En relación a las multinacionales españolas, también fue favorable, por su participación en grandes proyectos de obra civil que supusieron importantes ingresos en una época de recesión económica y reducida inversión en España. Resumen: El pasado siglo XX ha sido testigo de un renovado interés por los planteamientos de la filosofía aristotélica, en especial de la mano del filósofo alemán Martin Heidegger. Pues bien, junto con esta vuelta al estudio de la filosofía peripatética, ha surgido como en paralelo un nuevo interés por la filosofía del ser de Tomás de Aquino, en particular por su noción de esse ut actus essendi. Esto ha desembocado en diversas líneas de investigación, a veces confrontadas, que han (...) versado sobre todo en la cuestión de la recepción tomasiana de la noción de ente y los aspectos en ella implicados. En este trabajo se procurará dar a conocer algunos aspectos importantes de esta recepción, así como de esas distintas líneas de interpretación confrontadas. Abstract: The past 20th century has witnessed a renewed interest in the approaches of Aristotelian philosophy, especially from the hand of the German philosopher Martin Heidegger. Well, along with this return to the study of peripatetic philosophy, a new interest in the philosophy of being of Thomas Aquinas has emerged as a parallel, particularly in his notion of esse ut actus essendi. This has led to various lines of research, sometimes confronted, which have dealt mainly with the question of the Tomasian reception of the notion of being and the aspects involved in it. El objetivo de este texto es investigar sobre los posibles puntos de encuentro entre la psicoterapia existencial, un paradigma psicológico arraigado en las filosofías de la existencia, y el posicionamiento del profesor Marino Pérez Álvarez, quien se define a sí mismo como conductista radical, respecto a su manera de entender la existencia humana y el modelo más adecuado de psicoterapia. Para ello se proponen seis puntos de encuentro: necesidad de una fundamentación filosófica para la psicología, crítica al cientificismo y al (...) modelo médico, interpretación de los trastornos mentales como problemas de la vida cotidiana, recuperación del paciente como protagonista de la terapia, crítica a la psicología positiva y crítica al dualismo cartesiano. Se busca rastrear la imagen que Platón tiene de Heráclito y articularla con la estructura argumentativa del Cratilo, para comprender las necesidades textuales a las que responde la doctrina del flujo perpetuo, es decir, la discusión sobre la corrección (ὀρθότης) del nombre. Gracias a la inclusión del testimonio heraclíteo, resulta posible rastrear la presunta consolidación de la tesis sobre los nombres primarios y los secundarios como el eje de la separación entre dos planos de realidad (uno estable y uno móvil) (...) y de la teoría de las Ideas -es decir, como la base de la epistemología platónica presente en los diálogos de madurez-. The article seeks to trace the image Plato has of Heraclitus and connect it with the argumentative structure of the Cratylus in order to understand the textual needs that give rise to the doctrine of perpetual flux, that is, the discussion regarding the correctness (ὀρθότης) of names. The inclusion of Heraclitus's testimony makes it possible to trace the alleged consolidation of the thesis regarding primary and secondary names as the axis of separation between two levels of reality (one stable, the other, changing) and the theory of Ideas -that is, as the basis of Plato's epistemology as set forth in the late dialogues-. De especial interés resulta aquí la cuestión de la preeminencia del testigo respecto a otras instancias en la construcción del relato. Una cuestión que está, sin duda, estrechamente vinculada a las diferentes concepciones del tiempo histórico y de su experiencia. A este respecto, merece especial atención la figura del historiador alemán (...) Reinhart Koselleck por el destacado papel que jugó en los debates en torno a los monumentos erigidos en conmemoración a las víctimas del Holocausto, pero también por las deficiencias teóricas de la historia conceptual koselleckiana a la hora de abordar el papel de las emociones que emanan de la experiencia histórica.: This article is about the problematic of historical experience and several of its ramifications. Of special interest here is the question of the pre-eminence of the witness in relation to other instances in the construction of the story. This question is undoubtedly closely linked to the different conceptions of historical time and its experiences. In this respect, the figure of the German historian Reinhart Koselleck deserves special attention for the prominent role he played in the debates concerning the memorials built in commemoration of the victims of the Holocaust, but also for the theoretical weaknesses of Koselleckian conceptual history in dealing with the role of emotions emanating from historical experience. FENOMENOLOGIA Y FISICA EN HUSSERL, WEYL Y NEELAMKAVIL: MATERIA-CAMPO BASADO EN EXTENSIÓN-CAMBIO Castillo Ochoa, Ruth Transferencias Interculturales e Históricas de la Europa Medieval Mediterránea RESUMEN La historia de la terminología científica posibilita dar cuenta de 'cambios lingüísticos' o contingencia de términos en Ciencia. La Fenomenología de Husserl resulta un marco filosófico completo para elucidar significados en terminología científica enfatizando el carácter a priori de conceptos fundacionales, su aspecto contingente (lenguaje), intersubjetividad, sujeto transcendental y epojé. En tal sentido, soportar las (...) nociones fundacionales en física bajo las categorías universales Extensión-Cambio de Neelamkavil contribuye al ideal husserliano. Aún no se llega a una imagen adecuada de las intricadas relaciones entre Filosofía y Ciencia. Sin embargo, los hallazgos científicos de Moser-Britt (2014) soportan posiciones kantianas y husserlianas en torno a los términos a priori que fundamentan las teorías físicas. Como consecuencia, los resultados han despertado el interés de filósofos y científicos hacia las ideas husserlianas en tanto terminología lingüística y comprensión aprioricista del mundo. De esta forma, dentro del estado actual del arte, P. Berghofer y H. Wiltsche (2018) abordan el rol de fenomenología en Filosofía de la Física; mientras J. Drummond (2019) en "Husserl: German Perspectives" analiza el rol de la fenomenología en Ciencia. R. Neelamkavil (2018) da cuenta de un nuevo conjunto de categorías en física que comulgan con las ideas de Husserl. La comprensión de los términos Masa y Campo en física, se aborda el estudio de H. Grelland "Husserl, Einstein y Weyl and Concepts of Space, Time and Space-Time" y H. Weyl, "Space, Matter and Time". Un análisis metalingüísitico entre términos científicos y fenomenológicos no se ha realizado aún. Even if it has not been so thoroughly investigated, the importance of Platonic philosophy in Benjamin’s work can hardly be argued. Numerous texts, notes and letters reveal the presence of Plato in Benjamin’s thought. But it is specially The origin of German Trauerspiel the place where Benjamin takes Plato’s philosophy most explicitly and extensively. In the “Epistemocritical Preface” –where he develops his theory of knowledge through a revindication and reinterpretation of the Platonic “doctrine of ideas”– as well as in other (...) sections of the book, Plato appears as a fundamental source. In this context, a dialogue stands out: the Symposium. This article aims at investigating Benjamin’s reading of that dialogue, a reading which articulates the figure of a Plato that develops his philosophy as a way to oppose myth, and that allows to elevate philosophy again as a form for the exposition of truth in language. Knowing makes (...) possible saying, and saying determines speaking, or, in other words: speaking involves saying and knowing, and saying involves knowing. Language is nothing but human subjects in as much as they speak, say and know. Language is something coming from the inside of the speaking subject manifest in the intentional meaningful purpose of the individual speaker. A language, on the contrary, is something coming from the outside, from the speech community, something offered to the speaking subject from the tradition in the technique of speaking. The speech act is the performance of an intuition by the subject, both individual and social.

El presente texto examina la relación entre las valoraciones de la normalización filosófica en Colombia y el intento particular del filósofo Germán Marquínez Argote de realizar una historia de la filosofía colonial en clave latinoamericanista. Ello, para dar algunas luces sobre la continuidad de la filosofía latinoamericana en Colombia respecto del proceso local de normalización filosófica, siguiendo así algunas de las conclusiones de la historia de las prácticas de escritura. Esta continuidad no debe entenderse como una suerte de secuencialidad histórica, (...) de modo que la filosofía latinoamericana fuera la sucesora de la filosofía "normalizada". Por el contrario, se ha de entender como una reincidencia en los modos de valorar, que aparentemente estarían en contraposición según la comprensión de la primera como filosofía regionalista y de la segunda como universalista. En este sentido, el artículo comporta tres momentos. De manera introductoria se contextualiza el escenario filosófico local y latinoamericano, mostrando la presunta oposición entre latinoamericanistas y normalizadores. Luego, se expone cómo Marquínez Argote articula el proyecto latinoamericanista en Colombia y cómo pretendería estar valorativamente contrapuesto a la normalización. Finalmente, se evidencia, mediante un análisis narrativo de los textos que Marquínez Argote realiza sobre la filosofía en la Colonia, cómo reitera los valores de los normalizadores. Esto permite concluir la tesis central del artículo: la continuidad valorativa entre latinoamericanistas y normalizadores, en contraste con su frecuentemente asumida contradicción. (shrink)

The human subject in as much as he knows transforms the sensitive and concrete (the thing perceived) into abstract (an image of the thing perceived), the abstract into an idea (imaginative representation of the thing abstracted), and ideas into contents of conscience (meanings). The last step in the creation of meanings, something being executed in the speech act, consists in fixing the construct mentally created thus making it objectified meanings in the conscience of speakers. Speakers live language, that is, they intuit, create, acquire, perform, speak and say, interpret, use, evaluate and, even, speak of language. The real language is the language lived by speakers. On the contrary linguists, who at the same time are speakers and linguists, study language as something manifesting of front of them. In order to study language it is necessary to determine the degree of reality of the thing called language as the reality lived and used by speakers.

Meaning defines language because it is the internal function of language. At the same time, meaning does not exist unless in language and because of language. From the point of view of the speaking subject meaning is contents of conscience. From the point of view of a language, meaning is the objectification of knowledge in linguistic signs. And from the point of view of the individual speaking subject, meaning is the expressive intentional purpose to say something.

When we speak of language we usually use the concept of a particular language. In this sense the concept denoted with the word language may vary from one language to another. Real language (=the language spoken) on the contrary is the reality lived by speakers thus encompassing complex and multifarious activities. Depending on the language spoken, the modes of thinking, modes of being in the conception of things, and systems of beliefs transmitted by means of particular languages, denote the living (...) reality of language with different grammatical categories. The concept “language” is expressed sometimes with a noun, thus denoting something existing in it; sometimes with a verb, thus denoting an action or an activity; and sometimes with an adverb, thus denoting the mode of an activity. The reality or degree of reality implicit in these grammatical categories involves a particular mode of thinking, prompted with a particular mode of being in the conception of things. Because of this it is necessary to distinguish the concept of language as something different from the reality of language. But first of all it is necessary to determine the reality or degree of reality of both the reality lived by speakers and the thing usually conceived of as language or a language. (shrink)

Unfortunately, there are still cases of domestic violence or situations where it is necessary to call for help without arousing the suspicion of the aggressor. In these situations, the help signal devised by the Canadian Women’s Foundation has proven to be effective in reporting a risky situation. By displaying a sequence of hand signals, it is possible to report that help is needed. This work presents a vision-based system that detects this sequence and implements it in a social robot, so (...) that it can automatically identify unwanted situations and alert the authorities. The gesture recognition pipeline presented in this work is integrated into a cognitive architecture used to generate behaviours in robots. In this way, the robot interacts with humans and is able to detect if a person is calling for help. In that case, the robot will act accordingly without alerting the aggressor. The proposed vision system uses the MediaPipe library to detect people in an image and locate the hands, from which it extracts a set of hand landmarks that identify which gesture is being made. By analysing the sequence of detected gestures, it can identify whether a person is performing the distress hand signal with an accuracy of 96.43%. (shrink)

In it the activity of speaking cannot be understood unless it is referred to the concepts of language and a language. Anything in language can be found in the activity of speaking. Because of this you can find what language is if you abstract from the innumerable manifestations of the activity of speaking.

Meaning as the original function of language is the arrangement of internal things on the part of the creative and historical individual subject who speaks a particular language. Meaning constitutes the series of contents making up the linguistic world human subjects can manage real things with. Real things are not described with meanings but merely represented and designated. Meanings represent the essence of things thus making them members of a category. In this sense, meaning is the base to create things (...) in as much as they constitute entities. Only through the operation of determination can meanings designate individual real things. Since meaningful categories are intended to particular purposes, meaning is intentional and inclusive. (shrink)

RESUMEN En sus textos tempranos, Schmitt recurrentemente se dedica a criticar lo que se conoce como “positivismo jurídico”. Su principal objeción, como bien ya se deja ver en Ley y juicio, es que esta teoría se queda en la pura abstracción de los textos jurídicos y no toma en consideración los aspectos concretos de la realidad a la que las categorías normativas se deben aplicar Este trabajo pretende justificar que ya en estos textos tempranos el pensador alemán identifica que uno (...) de los principales problemas del positivismo jurídico radica en el hecho de que se construye sobre la base de una interpretación ontológica del ser humano que resulta inadecuada. En particular, argumentaremos que Schmitt aboga por una comprensión del fenómeno jurídico que se erija sobre la base de la consideración de la existencia humana concreta, lo que importa, a su vez, el reconocimiento de ciertas estructuras fundamentales y originarias que operan en todo conocimiento humano. ABSTRACT In his first legal texts, Schmitt repeatedly engages in criticizing what is known as “legal positivism”'. His main objection, as it is well seen in Law and Judgment, is that this theory remains in the pure abstraction of legal texts and does not take into account the concrete aspects of reality to which the normative categories should apply. This work aims to justify that in those first texts, the German thinker identifies that one of the main issues of legal positivism lies in the fact that it is built based on an inadequate ontological interpretation of the human being. In particular, we will argue that Schmitt defends an understanding of the legal phenomenon that is constructed based on the consideration of concrete human existence, which in turn means the recognition of certain fundamental and original structures that operate in all human knowledge.
